Australia Moves Toward National E-Bike and E-Scooter Safety Standards

Australia is moving to tighten the rules around e-bikes and other forms of electric micromobility, and this time the focus is not only on how people ride them. The federal push is aimed at the products that can be sold in the first place.

The Australian Competition and Consumer Commission (ACCC) has named e-micromobility safety as one of its 2026–27 product safety priorities. It plans to develop nationally consistent standards for e-bikes first, followed by other devices such as e-scooters, with issues including power limits and lithium-ion battery safety.

A sales and product-safety gap is the real target

Rules governing the use of e-bikes and e-scooters still vary between Australian states and territories. That creates an awkward gap: a device may be easy to buy, yet still fail to meet the rules for legal use on public roads or shared paths in a particular jurisdiction.

The federal work is therefore about creating clearer, more consistent product standards. The concern is not the ordinary low-powered e-bike that behaves like a bicycle, but high-powered machines that increasingly blur the line between bicycle and motorcycle, along with risks involving batteries, chargers and modifications.

250W and 25km/h are already important reference points

Australia has returned to the European EN 15194 standard as an important benchmark for e-bikes. In jurisdictions already applying that framework, a compliant e-bike generally uses pedal power as its primary means of propulsion, has a maximum continuous rated motor output of 250W and stops providing assistance above 25km/h.

That does not mean the final nationwide sales standard has already been settled. The ACCC's work is still being developed, and the final scope, transition arrangements, retailer obligations and enforcement details remain to be announced.

Injury numbers are adding pressure

New South Wales recorded 226 e-bike-related injuries in 2024. In the first seven months of 2025, the figure had already reached 233, along with four fatalities.

Queensland has also seen a sharp rise in injuries involving electric personal mobility devices. Metro North Health data from participating emergency departments showed presentations increasing from 1,626 in 2024 to 2,000 in 2025.

Those numbers do not mean every e-bike is inherently dangerous. Usage growth, rider behaviour, age, road design, illegal modifications, high-powered devices and protective equipment all affect the outcome. What regulators are increasingly struggling with is a product category that can look like a bicycle while performing much more like a motor vehicle.

Why this matters beyond Australia

For Malaysia, the useful lesson is not whether the country should copy Australia's 250W or 25km/h thresholds. The bigger question is how regulators define the boundary between a bicycle and a motorised vehicle, how retail sales rules interact with road-use rules, and who is responsible for battery and charger safety.

In a market where two-wheelers are already a major part of daily mobility, that discussion is likely to become more relevant as electric two-wheel transport expands.

The real regulatory problem may not be the words “electric bicycle” at all. It is the growing number of products that no longer behave like bicycles but are still sold as if they do. Once performance approaches motorcycle territory, the lack of matching product standards, licensing, insurance or rider requirements becomes much harder to ignore.
